What You Need to Know After a Uber and Lyft Accident

Uber accidents and Lyft accidents are similar to car accidents. Just because someone else drives you doesn’t mean that they are excluded from car accidents. They are still car accidents.

However, Uber and Lyft accidents are generally rare. The drivers are most of the time more careful since getting in a rideshare accident is much more complicated and expensive than just a regular car accident.

In 2017 and 2018, there were 97 fatal crashes with 107 total deaths according to TechCrunch.

Depending on who is reading this, 107 total deaths could sound like a lot, so Uber and Lyft put the accidents into the perspective of miles traveled.

Uber and Lyft are always tracking their miles from all their drivers through the apps.

So, in context of miles traveled, there is only 1 accident per 100,000 miles.

To make it sound even better, Uber and Lyft accidents happen only 10 times per 1 billion miles driven.

Are Uber Drivers Actually Better?

This is one of the most common questions with Uber and Lyft accidents in Miami.

With rideshare apps getting more common by the day because it is easier than driving, it poses the question whether rideshare drivers are actually better or safer drivers than people like you or myself.

The quick answer is no. Rideshare drivers are just barely regulated or trained. There is no real standard other than surpassing a certain age and not having any accidents on your record for a fixed period of time.

These rideshare drivers are not like truck drivers and don’t have to go through rigorous training to drive. They are drivers just like you and me. In addition, truck drivers are actually considered employees. Uber and Lyft drivers in Miami are not considered employees of Uber. They are considered independent contractors. So the insurance for them is different than truck drivers that are considered employees.

With insurance policies being slightly different, reporting an Uber or Lyft accident in Miami can get complicated. If you got in an Uber accident, get in contact with an Uber accident lawyer in Miami. We can guide you through the complicated legal process of getting your financial compensation from negligent driving.

Uber or Lyft? Which one is safer?

If you have never been driven in an Uber or Lyft and just want to get somewhere very quick but are not sure, then here is the short answer.

They are both the same.

There is honestly nothing that different between Uber and Lyft in terms of the apps and the driving experience.

Both rideshare services have background checks and try to ensure the safety of the passenger as best as possible through their screening process.

If you are just using Uber or Lyft just once, then it doesn’t really make a difference.

But, if you are going to be a regular Uber user because you are new to the city or don’t have a car, then keep reading.

Between Uber and Lyft, the biggest difference actually comes in quality and variety of services in rides.

To start, Uber is a much bigger company than Lyft. In 2014, Uber had generated around $10 billion, which makes Lyft’s $130 million look like child’s play.

In addition, Uber is available internationally. Uber is spread out through 250+ cities and 68 countries. On the other hand, Lyft is available nationally and does not go out of the USA. Even nationally, Lyft is only available in 31 states. Uber’s coverage nationally and internationally is just much more widespread and bigger.

Now going past the coverage and revenue, Uber also has a bigger variety of rideshare options.

With UberPool, you can carpool with other random people.

For the cheaper options, there is also UberX. If you want something fancy and luxurious, UberBLACK is the way to go. UberBlack is basically a high-end SUV with a professional driver. It is much more strict and selective than just the regular Uber.

Finally, if you are too fancy for anything else and only take high-end luxury, then UberLux or UberPlus is the choice for you. These drivers are always professional and the cars close to or are 6 figures.

On the other hand, Lyft has only three choices.

Being driven by someone else is the first choice. Then there is LyftLine, which is a cheaper option. Then there is LyftPlus, which the name suggests, can seat up to 6 people in one car. But that is it for Lyft in terms of choices.

So, if you are going to be a regular rideshare user, then Uber is probably the way to go. Much more options and the quality from the professional drivers is better than the non-professional drivers from Lyft and the small variety in their choices.

Is Riding An Uber or Lyft Safer Than Driving?

The main purpose of riding an Uber or Lyft is to go home safely.

You are on a night out with friends and are going to go clubbing and drink alcohol. Obviously you CANNOT drink and drive. Even your designated driver got drunk. So now you have no options. What do you do? Order an Uber or Lyft.

So yes, it is technically safer to be in an Uber or Lyft.

However, the drivers driving in an Uber vs a regular car are no different. Yes they may take precautions to try and avoid accidents as much as possible, but they are not exempt from the fact that accidents can happen.

So if you are not in the condition to drive, then Uber and Lyft are definitely safer. But, when you consider the Uber and Lyft drivers as just regular drivers, they are just as susceptible to accidents as we are.

If confused, it is important to note what was said previously. Uber and Lyft drivers are actually not rigorously trained or are even considered employees of those companies. They are considered independent contractors so that Uber and Lyft don’t have to be held responsible for the individual driver’s actions.

That doesn’t mean that there isn’t an insurance policy or any way to get the financial compensation from the party that is at fault.

What is the Time Limit to File a Claim on a Miami Uber Accident

To be specific, there is no specific statute of limitations (time limit) that designates to just Uber and Lyft accidents in Miami.

However, there is a statute of limitations for all personal injury cases, which is 4 years. This applies to all car accident cases.

Since Uber and Lyft accidents in Miami are considered car accidents, there is 4 years to file a claim for an Uber accident in Miami.

Frequently Asked Questions

Still open questions?

Ideally, you will want to hire a personal injury lawyer as soon as you get injured. If you are injured and your body is in pain, why wait and live with the pain? That makes no sense. You want to get rid of the pain as soon as possible. If you have more questions contact us

That depends on how badly you were injured. People joke around about “I wish I got hit by a car” or “If I slip and fall here, I’m gonna make a fortune”. Although that is possible, it is not always possible. They are jokes for a reason. You will make as much as you are owed. If it is just a scratch, then you will not be compensated much. If you had to have major surgery and are going through rehab, then you will make MUCH more than just a simple scratch or small bump.

As a personal injury lawyer in Miami, what I do is make sure that you make your money back (maybe even more) from whatever damages you sustained. If someone else caused your injuries, then you have to contact us and consult with our team. We will make sure that you are taken care of. My job is to see if your current situation is actually someone else’s fault and if you can get your money back for the treatment you went or are going through.
