Pain and suffering is hard to calculate.

Let’s start with that right of the bat. 

Pain and suffering is not something that you can just put a finger on and give a rough estimate right from the go.

In fact, with so many different factors that go into what causes pain and suffering, I personally don’t believe that it is possible to make an accurate estimate without spending time with your client and hearing out their story and how severely they see their injuries.

So, what goes into the injury calculators?

What is an Injury Calculator?

Basically, an injury calculator is an estimator that will have you input your potential losses such as income or injuries, and then give a numerical estimate as to how much you will receive for the injuries you suffered.

For example, most calculators will get your injury by average value and multiply it by severity. So for example, a scrape on your knee will not be the same value as a broken bone. There is much more “value” in fixing a broken bone than healing from a scrape. A broken bone requires a big operation to put it back in place and then after you get out of the surgery, you would have to put on a massive cast and also deal with more discomfort after. 

So what the calculators mostly do is that they get the average cost of the injury and multiply it by a certain number to get the estimate. This “certain number” is mostly from a range of 1 to 5. 1 being the least painful and 5 being the most painful.

Can I Rely on an Injury Calculator?

Honestly, relying on an injury calculator as a replacement for a personal injury lawyer is not a good idea. In fact, I wouldn’t even recommend it or even possibly go against that. An injury calculator is not a replacement for proper legal guidance. 

The injury calculator can grossly miscalculate your injuries either too much or too little. In addition, an injury calculator will not give you the proper guidance to receive that financial compensation. Receiving financial compensation from the insurance companies or the other party is not as easy as just asking for the money.
You will have to deal with adjusters, insurance companies, and lawyers. They will all try to haggle down your financial compensation so that you get less than what you deserve. 

Don’t get caught up in the legal battles and terms. The process can get long and confusing and it is possible that your pain and suffering gets worse.
